We respect your privacy and want to use this Privacy Policy and Terms of Use (the “Policy” or “Terms”) to describe how we use and share the information we collect about you through our Services. To make this document easier to read, we’re going to use some abbreviations throughout. “VOM” or “us” or “we” refers to The Voice of the Martyrs, Inc., which operates the Service. Reference to “Mobile Application” refers to the VOM mobile application and any of its related products and services, and “the Service” collectively refers to the Mobile Application, our website located at www.HeartsEvent.com, as well as the content and functionality offered through all of the foregoing. “You” or “user” refers to yourself and other users of the Service.

Accepting these Terms

Please read this Policy carefully as it controls your use of the Service and discusses how we collect, use, share and process your information. This Policy is a legally binding agreement between you and VOM. If you are entering into this agreement on behalf of a business or other legal entity, you represent that you have the authority to bind such entity to this agreement, in which case the terms “user”, “you” or “your” shall refer to yourself as well as that entity. If you do not have such authority, or if you do not agree with the terms of this Policy, you must not accept this agreement and may not access and use the Services.

By accessing and using the Services, you acknowledge that you have read, understood, and agree to be bound by the terms of this Policy on behalf of yourself and the entity for which you consent to this agreement (if any). By accessing our Service, you also agree to these terms and consent to having your data transferred to and processed in Canada as well as the United States.

Your Personal Information: An Overview of How We Collect, Use and Share It

Below is a brief overview of the personal information we collect via the Services and the purpose for our collection. A more detailed description is found below.

What We Collect and How We Use that Information

We collect data from you when you provide it to us, including when you use the Services and when you send, receive, or engage in messages with us. We use that information to provide our Service; to fulfill any purpose for which you provide the information; to enforce our rights and fulfill our obligations; to send you notices and other messages; to comply with our legal obligations; in manners described in this Policy; for any other purpose for which we have your consent; and for our legitimate interests, including, without limitation, to support our business, for internal analytics, and to improve our website, products and services.

You can access and use the Services without providing information from which someone could identify you as a specific, identifiable individual. If, however, you wish to use certain features offered via the Services, you may be asked to provide personal information such as your name and email address to help us in authenticating you as the user for your account and to maintain your preferences and other information you retain and use via the Services.

Beyond the personal information collected to create an account, you have choices about what additional information you provide to us. We collect personal data from you when you provide, post, or upload it to the Services. We also ask for payment information where you seek to use the Services to provide a donation or make a payment, and may also collect information about your location to help connect you with our nearby partners. Any of the information we collect from you may be used for the above as well as the following purposes:

  • Create and manage your user account
  • Send ministry and administrative information
  • Process financial transactions
  • Send you product and service updates
  • Respond to your inquiries and provide support
  • Request user feedback
  • Improve user experience
  • Enforce this Policy
  • Protect our users from abuse and malicious users
  • Respond to legal requests and prevent harm
  • Run and operate the Services

We may also combine the information we collect with information provided by third parties or which is publicly available to better personalize and/or improve the Services. Please note that your name, email, and mailing address are needed to create an account with the Mobile Application. Beyond this personal information, you do not have to provide other information to us; however, if you do not, it may limit our ability to personalize the Services and your ability to use the Services to their fullest extent.

Automatic Collection of Information

We use cookies and similar technologies as described in our Cookie Notice. By using our Services, you agree to our Cookie Notice.

Analytics and Performance

We internally analyze the personal data available to us and the use of the Services, as well as the inferences we make from that data, to provide and update Services, communicate with you and process information as discussed in this Policy, and for internal analytics such as to observe social, economic, and geographic trends as they pertain to Services content. In some cases, we work with trusted third parties to perform this research, under controls that are designed to protect your privacy, as discussed below. We also use de-identified and aggregate user data to market the Services, including communications that promote Services use and growth. We use data, including user provided personal information, aggregations of user data, data collected through the use of Services, data from third parties, publicly available information, public feedback, and information inferred from this data to conduct internal research and development in order to provide a better overall experience, measure the performance of Services, and increase the use of the Services.

We may also disclose your personal information as described below.

Disclosure on Your Behalf

We may disclose personal information that we collect for the purpose that you provide the information or for another purpose for which we have your consent.

Internal and De-Identified Disclosure

We will share your data internally within VOM to help improve our services. We may disclose aggregated non-personally identifiable information about our users, the use of the Service as well as any data related to or in connection with the Service that does not identify an individual, in each case without restriction.

Legal Process

It is possible that we will need to disclose information about you when required by law, subpoena, or other legal process or if we have a good faith belief that disclosure is reasonably necessary to (i) investigate, prevent, or take action regarding suspected or actual illegal activities or to assist government enforcement agencies; (ii) enforce our agreements with you; (iii) investigate and defend ourselves against any third-party claims or allegations; (iv) protect the security or integrity of the website; or (v) to exercise or protect the rights and safety of VOM and others. We may attempt to notify you about legal demands for your personal data when appropriate in our judgment, unless prohibited by law or court order or when the request is an emergency. We may dispute such demands when we believe, in our discretion, that the requests are unlawful, overbroad, vague, or lack proper authority, but we do not promise to challenge every demand.

Disclosure to Our Service Providers

We may disclose personal information that we collect or you provide to third party service providers that we use to support our business and to process your requests. These service providers are not authorized to use or disclose your information except as necessary to perform services on our behalf or comply with legal requirements. Service providers are given the information they need only in order to perform their designated functions, and we do not authorize them to use or disclose any of the provided information for their own marketing or other purposes. The service providers for the Services provide the following categories of services:

  • Cloud computing services
  • Communication and collaboration services
  • Data analytics
  • Data storage
  • Performance monitoring services
  • Product engineering and design services
  • User authentication services
  • Website hosting services

Retention of information

You can delete your Mobile Application account at any time using the settings function in the Mobile Application; however, when you delete your account we will delete the information associated with your account. If you do not want to delete your account or this information, you may cease using the Mobile Application and we will maintain your account and the information associated with your account until you resume use or delete your account, whichever comes first.

If you choose to delete your account or ask that we modify or delete personal information, we will delete and purge personal information we have stored about you in a way that is electronically irreversible, however, we may retain certain personal data to honor your do-not-email and other requests, if we have a legal right or obligation to maintain the information or to meet regulatory requirements, resolve disputes, maintain security, prevent fraud and abuse, enforce our rights, or fulfill any other requests from you (for example, to opt-out of further messages or for a copy of your data). We will maintain aggregated statistics based on de-identified information and inferences we have made concerning your use of the Services even after we have deleted your personal information.

Social Media

Our Services may include features that allow you to share or post content from the Services to designated social media accounts, and vice versa (collectively, “Social Media Features”). These Social Media Features may collect your personal information to do so (such as your IP address and the content you wish to share) and may also require the use of a cookie to enable the Social Media Features to function properly. By using Social Media Features, you consent to such collection and use and you agree that processing of your personal information by companies that operate social media platforms is governed by the privacy policy of these platforms’ respective providers and not VOM.

Third Party Affiliated Ministries

As a result of our founders’ worldwide travel and testimony, numerous ministries throughout the globe share the VOM mission and wish to connect with users of our Services. We do not share your personal information with these third parties unless you consent to the same. If we determine that there is a VOM partner near you, we will (i) only share your personal information with that partner if you provide express consent for us to do so; and (ii) only share your contact information with the partner on a confidential basis and only if the partner agrees to keep the information we share about you confidential; and (iii) provide an additional prompt to you as a reminder of these terms, which you must agree to at that time before we will provide the partner with your contact information and no information will be shared until you grant approval to our prompt. If you consent to this prompt, your interactions with our partner are solely among you and that partner.

Donations

If you choose to provide a voluntary donation through the Services or a website linked to the Services, then and only then will you be prompted and required to provide credit card, bank account, and other payment information necessary to process the transaction. We will collect the restriction for your donation, if you provide one, as well as personal information such as your name, address, country, phone number, and/or email address to ensure that your donation is used for the purpose you request. We will not store or otherwise process financial information provided to us online for the purposes of donating. As of the date of this Policy, we use Stripe, PayPal or TSYS to process your online donation payments. Sensitive Data

By downloading and using our Services, we do not assume that you are of any particular religious affiliation or are expressing to us any particular religious belief; we merely assume that you are interested in the content we provide. We do not require that users provide information about such beliefs or provide any other sensitive data such as race, ethnicity, philosophical beliefs, or physical or mental health to use the Services or to create or maintain an account. Because you may have control over certain content you create, share, and store through the Services, you may have the opportunity to provide us with sensitive information, and if you do we will assume we have your consent to process that information.

Service and Marketing Messages

We may use your information to contact you about product and service offerings by electronic newsletters or otherwise. You have the right to opt-out of such messages. We also offer push notifications which you may voluntarily subscribe and unsubscribe to at any time. We may use your information to investigate, respond to and resolve legal, security or technical issues and complaints and as necessary for security purposes or to investigate possible fraud, or violations of law. We may use your information to contact you about these security, legal and other service-related issues. Please be aware that you cannot opt-out of receiving such messages from us.

Privacy of Children

We do not collect personal information from any person we actually know is under the age of 16 without the consent of the parent or legal guardian of that minor. A parent or guardian may consent to the use of our Services. Should you allow your minor child to use your account (whether through your profile or a secondary profile), you shall be solely responsible for providing supervision of the minor’s use of our Services and assume full responsibility for the interpretation and use of any information or suggestions provided through our Services our Services. If you have reason to believe that a child under the age of 16 has provided personal information to us without parental or guardian consent, please contact us so that we may remove their information from our database. We encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce this Policy by instructing their children never to provide personal information through the Services without their permission.

Managing Your Information

For personal data that we have about you, you may make certain requests:

  • Deletion: You may ask us to erase or delete all or some of your personal data. Please note that doing so may limit your ability to use certain functionality of the website and/or aspects of our services.
  • Correction/Modification: You may ask us to change, update, or fix your data in certain cases, including if it’s inaccurate.
  • Object to, or Limit or Restrict, Use of Data: You can ask us to stop using all or some of your personal data or to limit our use of it.
  • Right to Access and/or Take Your Data: You can ask us for a copy of your personal data you have provided to us so long as we are able to verify your identity when you make such a request.

To make these or any other requests with respect to your personal information, you may contact us at the contact information above or you may have the option to delete or modify your information through use of the settings function in the Mobile Application. We ask that individuals making requests identify themselves and identify the information requested to be accessed, corrected or removed before we process any requests. We may decline to process requests if we cannot verify the requestor’s identity, if we believe the request will jeopardize the privacy of others, if we believe the change would violate any law or legal requirement or cause the information to be incorrect, or for a similar legitimate purpose.

We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time, we will inform you of the reason and extension period in writing. We will deliver our written response by mail or electronically, at our option. The response we provide will also explain the reasons we cannot comply with a request, if applicable. If we modify or delete some or all of your personal information, we will retain your personal data if reasonably necessary to comply with our legal obligations (including law enforcement requests), meet regulatory requirements, resolve disputes, maintain security, prevent fraud and abuse, enforce obligations or fulfill any other requests from you (for example, to opt-out of further messages or for a copy of your data). We will not discriminate against you for exercising any of your rights under applicable law. We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Some information you have created, received, or used in the Services may not be available in a usable form outside of the Services. As a result, when you request a copy of your personal information, we will be able to provide personal information you have provided to us, such as your name, address, phone number and the like; however, we may be unable to provide you with content and User Contributions that utilize Mobile Application functionality.

Links to Third Party Resources

Please keep in mind that the website may contain links to other websites or apps. We do not control these third parties’ privacy practices or tracking technologies. If you have any questions about targeted content, you should contact the responsible provider directly. You are responsible for reviewing the privacy statements and policies of those other websites you choose to link to or from our website, so that you can understand how those websites collect, use and store your information. We are not responsible, or liable to you or any third party, for the privacy statements, policies or content of third parties, including websites you link to or from our website or the accuracy of any materials provided by third party websites.

Security and Protection

We implement security safeguards designed to protect your data. These include using encryption for your data while it is being transmitted between your device or browser and servers used to store that information. We maintain reasonable administrative, technical, and physical safeguards in an effort to protect against unauthorized access, use, modification, and disclosure of personal information in our control and custody; given the nature of communications and information technology, and that use of the internet has inherent risks, we cannot warrant or guarantee that information provided to us will be absolutely free from unauthorized intrusion by others, nor can we warrant or guarantee that such data may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.

Therefore, while we strive to protect your personal information, you acknowledge and agree that (i) there are security and privacy limitations of the Internet which are beyond our control; (ii) the security, integrity, and privacy of information and data exchanged between you and us via the Services cannot be guaranteed; (iii) any such information and data may be viewed or tampered with in transit by a third party without your or our consent; and (iv) as the security of personal information depends in part on the security of the device you use to communicate with us and the security you use to protect your credentials, you will take appropriate measures to protect this information and secure your account from unauthorized use.

Legal Notices

We may use your personal information to provide you with notice regarding a security incident or data breach, by: (i) sending a message to the email address you provide (as applicable); (ii) posting to a publicly facing page of our website; (iii) through major statewide media; and/or (iv) telephonic means, including calls and/or text messages, even if sent via automated means including automated dialers (standard text and data messaging rates may apply from your carrier). Notices sent by e-mail will be effective when we send the email, notices we provide by posting will be effective upon posting, and notices we provide through telephonic means will be effective when transmitted or dialed. You consent to receiving electronic communications from VOM relating to any security incident or data breach. It is your responsibility to keep your email address and any other contact information you provide to us current so that we may provide these communications to you.

Lawful Bases Processing

We will only collect and process personal data about you where we have a lawful basis. Lawful bases include those uses and disclosures identified in this Policy, your consent, contract, and other legitimate interests. Such legitimate interests include protection to you, us and third parties, to comply with applicable law, to enable and administer our business, and to contact you concerning changes in law, invitation to our events and information about our services. Where we rely on your consent to process personal data, you have the right to withdraw or decline your consent at any time. Where we rely on legitimate interests, you have the right to object. Intellectual Property Rights

The Services and its contents, features and functionality (including but not limited to all information, software, text, displays, images, video and audio, and the design, selection and arrangement thereof), excluding User Contributions, are owned by VOM, its licensors or other providers of the material and are protected by law.

Acceptable Use of the Services

You may use the Services for your personal, non-commercial use only. Prohibited uses and activities using the Services include, without limitation, any use of the Service in a manner, that in VOM’s sole and reasonable judgement, involves, facilitates, or attempts any of the following:

  • permitting access to the Service by a third-party with your account information;
  • accessing any computer, network, data, or communications system without authorization, including the computers, networks, data, or communications systems used to provide the Service;
  • penetrating or disabling any security system;
  • distributing or introducing a computer virus, launching a denial of service attack, or in any other way attempting to interfere with the functioning of any computer, network, communications system, or website;
  • accessing or otherwise interfering with the accounts of others or engaging in any activity that disrupts, diminishes the quality of, interferes with the performance of, or impairs the Services or the Service functionality;
  • violating any law of, or committing any conduct that is tortuous or unlawful in, any applicable jurisdiction;
  • using the Service in violation of any other agreement or policy of VOM regarding use and access of the Service;
  • exporting or allowing access to the Service in any manner contrary to the export regulations of the United States;
  • downloading, copying, saving, framing, retrieving, or storing in electronic or any other form any part of the Service in any manner other than as expressly permitted hereunder;
  • disassembling, decompiling, decoding, or reverse engineering, the Service or any software included in or with the Service;
  • infringing upon the copyrights, trademarks, trade secrets, or other intellectual property rights of any person or entity;
  • removing, deleting, altering, or obscuring any trademarks or any copyright, patent, or other intellectual or propriety rights notices from the Service;
  • violating the privacy rights of any person;
  • distributing, publishing, sending, storing or facilitating unsolicited communications or material that is defamatory, abusive, of an obscene or threatening character, pornographic, lewd, or excessively violent, regardless of whether the material or its dissemination is unlawful;
  • engaging in any behavior that stalks, harasses, or harms anyone; and/or
  • advocating or inducing illegal activity.

You are responsible for any actions that are performed via your account, whether performed with or without your authorization. Violation of the above and this Policy may lead to suspension or termination of the user’s account or legal action. If you are aware of a violation by a user of the Service, please contact us at the information found at the beginning of this Policy.

VOM does not intend, and is not obligated, to review, monitor, or control content or data that is sent, received, or stored in the Service unless required by law, including User Contributions, and VOM accepts no responsibility or liability to you or any other person for the content or data that are transmitted by or made available to you through the Service.

Disclaimer of Warranties/Limitation of Liability

We may update the content and functionality offered on or through the Services from time to time. THE SERVICES AND THEIR CONTENT AND FUNCTIONALITY ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WITHOUT LIMITING THE FOREGOING, VOM DISCLAIMS ANY AND ALL WARRANTIES OR REPRESNTATION THAT THE SERVICES WILL BE ERROR-FREE OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT THE SERVICES WILL BE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, AS WELL AS ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT AND FITNESS FOR PARTICULAR PURPOSE. THE SERVICES ARE PROVIDED AS A CONVENIENCE TO YOU. AS A RESULT, IN NO EVENT SHALL VOM OR ITS EMPLOYEES, AGENTS, OFFICERS OR OWNERS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICES OR ANY CONTENT OFFERED ON OR THROUGH THE SERVICES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, WHETHER UNDER A THEORY OF TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT OR OTHERWISE, EVEN IF FORESEEABLE. THE FOREGOING DOES NOT AFFECT ANY LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

Governing Law

The Services are offered in and from the State of Oklahoma and your use of the Services is governed by the laws of the United States and the State of Oklahoma. We may store or process your information outside your city, province, state, or country, including through one of our contractors and service providers. As a result, your personal information may be stored in a country or state that operates under privacy and data protection laws different from those of your home jurisdiction. Currently, servers storing information provided through the Services are in Canada.

Your submission of information to our Services and your consent to this Privacy Policy includes consent to such transfer, storage, and processing outside of your jurisdiction and in the United States and the State of Oklahoma. All matters relating to this Policy or the Services and any dispute or claim arising out of or related to the same shall be governed by and construed in accordance with the internal laws of the State of Oklahoma, without giving effect to any choice or conflict of law provision or rule, and you agree that any such dispute or claim shall be instituted exclusively in the federal or state courts sitting in Tulsa, Oklahoma. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

Entire Agreement

We reserve the right to modify this Policy or its terms at any time at our discretion. When we do, we will post a notification in the Mobile Application and/or send you an email to notify you that the Policy has been updated. We also reserve the right to modify the content and functionality of the Services at any time in our sole discretion, and nothing herein should be construed as any warranty or guarantee that any particular function or content will be available through the Services.

This Privacy Policy and Terms of Use and incorporated Cookie Policy constitutes the sole and entire agreement between you and VOM with respect to the Services and supersedes all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to the same. If any provision of the Privacy Policy and Terms of Use is held to be invalid, illegal or unenforceable for any reason, the remaining provisions will continue in full force and effect. We may update the foregoing from time to time, and the date of the last modification will be is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically visiting this Policy, to check for and receive notice of any changes.

Our Commitment to Transparency and Accountability

VOM was formed in the state of Oklahoma for the purpose of “serving persecuted Christians through practical and spiritual assistance and leading other members of the Body of Christ into fellowship with them.”
